GENERAL CONDITIONS:

RENTAL AGREEMENT, RATES AND PAYMENTS: The Lessee must carry a valid copy in paper of the rental agreement inside the rented vehicle. If not, the Lessee could be penalized by the Spanish Authorities. All ENTEPRISE ATESA rates are quoted in euro. The minimum rental period is one day (24 hours). An extra period of 59 minutes will not be charged, but once the said period is exceeded, charges for the entire day shall be collected. For your own convenience you may charge car rental to your ENTERPRISE ATESA card or any of the main credit cards. ENTERPRISE ATESA  will request an amount by way of deposit that may vary depending on the rented car group, and the way of payment, and that may at most be 1.200 €. In certain cases, additional accreditation and/or identification documents could be requested.

TAXES: The total amount is subject to the rate of V.A.T. or I.G.I.C. (general indirect Canary Islands Tax) applicable at any time. These taxes shall be paid by the customer and shall be applied to the total of rental charges.

 DRIVING ABROAD: The Lessee should inform to Atesa at contract opening about his intention to drive on foreign territory and shall be obliged to take out the International Assistance Coverage. The rented vehicles are allowed to drive through Austria, Belgium, France, Germany, Italy, Luxemburg, Monaco, the Netherlands and Switzerland, by purchasing International Assistance Coverage. This coverage cost is: 1 to 10 rental days: 50 €; 11 to 27 rental days: 80 €; 28 rental days or longer: 115 €. Driving through Portugal, Andorra and Gibraltar is permited, as well not being necessary to purchase the International Assistance Coverage; Informing about his intention to drive on those countries is still mandatory.  Any end point for a vehicle abroad must be previously authorized by ENTERPRISE ATESA. Industrial vehicles may in no case end their rental period outside Spanish territory.

Please, check legal requirements in each country you will drive into.

FINES AND EXPENSES: All traffic offences and expenses due to them, charges for parking and car wash shall be borne by the Lessee, or any other event (expense) arising during along with all those expenses arising during the rental period that the customer is responsible for, without prejudice of legal action that can be initiate.

MILEAGE: Depending on the rate applied, the rental could be inclusive of a certain number of free km per rental day. Once this mileage is exceeded, a surcharge per extra km will be applied depending on car group rented (see table attached). Apart from that, and independently, there is also a limit of 8.500 km per rental contract. Once this is exceeded, a penalty of 0,30 € per km will apply, in addition with the surcharge per extra km already written above. If a rental contract has above 30 days length , the limit will be proportionately distributed according to the final rental length, considering a number of 8.500 km every 30 days length.

INTERCITY PROGRAM: Available for cities within Spanish continental territory. Depending on rate, season, rental length and/or pick up or drop-off rental location, it may be charged with a fee up to 750 €.This does not allow for transit between the Peninsula and the Islands and vice-versa, or between Islands, nor to the independent cities of Ceuta and Melilla unless written authorization has been obtained from the Lessor.

FUEL: ENTERPRISE ATESA rates do not include the fuel consumed during the rental period. Normally, ENTERPRISE ATESA delivers the vehicle with a full tank, so should be returned with the same amount of fuel with which it was delivered to them. If, for any reason, the return of the vehicle thus fuelled is not possible, the amount corresponding to the fuel consumed shall be invoiced, plus 18 euro by way of expenses. The Lessee shall be responsible for correct vehicle fuelling. The Lessse could also purchase the Full Tank Option, avoiding like this refuelling the vehicle at the checkout. Availability and conditions for this Option can be checked at the rental branch.

ACCESSORIES: Children’s seats, luggage racks and other accessories are available to customers. These must be requested prior to car rental. This service shall have a charge of 54 euro per item rented, except in seats for children up to 36 kg weight, , which will be charged at 8 euro a day up to a maximum of 64 euro, in boosters without back for children over 36 kg, which will be charged at 4 € a day up to a maximum of 32,04 € and the GPS, which shall be charged at 9 euro a day up to a maximum of 90 euro. The Lessee shall be responsible for the preservation and good use of the accessories, including keys and documentation folder. Otherwise, a penalty covering the value of the lost / deteriorated accessory, without any prejudice of legal actions that can be taken by the Lessee. (1)

YOUNG DRIVER: For drivers under 25, a Young Driver fee will be applied:  9,68 € per day, up to a maximum amount of 96,80 € per driver and rental

ADDITIONAL DRIVER: For each additional driver, a charge of 8 euro must be paid for every day of rental up to a maximum of  72 euro.

MINIMUM AGE AND FIRST-ISSUED LICENCE DATE: The Lessee must will be required a first-issued driving license dated not shorter than 1 year, and must be at least 21 years-old, except for renting vehicle groups 6, 7, 8, J, M, V, W, Y and Z, for which must be 25 years old

For rentals in the Canary Islands, the Lessee must be at least 22 and hold a driving licence valid for at least two years from first date of issue in all cases.

DELIVERY AND PICK-UP:                                                                        

1) Downtown branches:From Monday to Friday, from 09:30 to 13:30 and from 16:30 to 19:00. Saturdays from  10:00 to 13:00.

2) Airport offices: Every day from 08:00 to 23:00.

The foregoing timetables are offered by way of reference and may be extended or restricted depending on the season and the office. Please do not hesitate to consult ENTERPRISE ATESA personnel in this regard. Some offices offer preferred delivery in counter with a cost of up to  36 euro, see availability.

All deliveries taking place elsewhere other than ENTERPRISE ATESA counters shall have a surcharge of 27 euro and 22 euro in case of pick-up outside the office. These must be confirmed 48 hours in advance.

 Outside of these schedules and/or of opening times in every single rental location, delivery / pick-up where a ENTERPRISE ATESA base exists shall have a surcharge of  50 euro.

 Delivery / pick-up in cities where there is no ENTERPRISE ATESA office shall have a surcharge of  0,61 euro for every kilometre (minimum of   50 euro) up to the nearest office. (retour kms. counted).

Vehicle return must be done by the Lessee within the return ENTERPRISE ATESA station opening time. In the return of vehicles at the end of the rental period outside  this opening time, , the  Lessee shall keep being responsible in the same terms provided in contract, until the vehicle shall be retrieved by ENTERPRISE ATESA, once the station re-opens.

AIRPORT AND RAILWAY STATION SURCHARGES: Pick up at airports shall involve an additional variable surcharge up to   36,30 €, for the first rental day, and   2,50 €, each additional day, from the second one. Pick up at railway and AVE stations may be charged with an additional fee up to 18 € per rental.

RESERVATIONS: We request our customers to inform us of the time they want to take out the vehicle as well as any possible delays in their flights to thus enable us to give them better service. ENTERPRISE ATESA shall maintain Vehicle Reservations up to a maximum of 120 minutes after the time of delivery set in the Reservation (provided that this period falls within office hours). Once the said limit is exceeded, the Reservation shall be cancelled and ENTERPRISE ATESA reserves the right to avail of the vehicle to cover the demands of other customers. When reservations are set to be picked up at rental stations situated in an airport, those reservations will be maintain up to a maximum time of  60 minutes after the time of delivery set in the reservation. (In the event of Reservations in which the customer declares to arrive in a flight, delivery time shall be understood as the actual arrival time of the flight).

Reserved vehicle model is by way of guidance, and could be replaced by another vehicle with similar characteristics within the same category.

SIGNAGE: It is expressly prohibited to substitute or modify the Integrated Signage of the ENTERPRISE ATESA vehicle, subject to a charge of 400 euro (600 euro in the case of Group 8 vehicles).

(1)     In some cases, accessories, ancillaries and surcharges could have a price lower than those maximum amounts published in the present General T&Cs. Besides, in some cases some of the said extra charges could be included in a given rate. All amounts in the present document are inclusive of VAT.

 COVERAGES AND DEDUCTIBLES:

Mandatory Coverage & Civil Liability:  ENTEPRISE ATESA rates include, at no additional cost, Spanish mandatory insurance as well as civil liability insurance for an amount limited to € 50,000,000 per damage in what may exceed mandatory insurance.

TP (Total Liability Waiver for Theft):  The Lessee may be totally exempted from liability for vehicle theft except for coverage exclusions and for reduced deductible, in the applicable cases - by paying the supplement for so-called Theft Protection coverage (TP). This coverage may be mandatorily included in some rates. Non applicable for groups 7 and 8. TP can be purchased only in addition to CDW

CDW (Partial Liability Waiver for Colission and Theft): In case that during the inspection made by ENTERPRISE ATESA at vehicle returning, damages non existing at the rental start were found, those ones will be the Lessee’s responsibility, and assumed by him/her. The Lessee may be partially exempted from liability for damages or loss to the vehicle caused by a collision, a theft or a theft attempt - except for Deductibles and coverage exclusions - by paying the supplement for so-called Collision Damage Waiver coverage (CDW). This insurance may be mandatorily included in some rates.

In the event that an accident occurred, the Lessee must communicate it to ENTERPRISE ATESA in less than 7 days, by fulfilling the form “Declaración amistosa de Accidentes”

SCDW (Total Liablity Waiver for Collision): Likewise, ENTERPRISE ATESA reserves the right to waive or reduce the deductible for damages and total liability for theft of the rented vehicle - except for coverage exclusions - by purchasing the additional coverage SCDW. ENTERPRISE ATESA reserves the right to have this coverage available to be bought. SCDW coverage could be included in some rates.  SCDW can be purchased only in addition to CDW and TP. Non applicable for groups 7 and 8.

SUPER PAI (Passengers & Driver + Luggage Theft Coverage): Likewise, ENTERPRISE ATESA avails of SUPER PAI coverage (Personal Accident Coverage and theft of luggage) which covers medical expenses for all ENTERPRISE ATESA rental vehicle occupants in the event of a driving accident, and a compensation in case of decease or total disability, up to the limit committed in the policy. Theft of luggage or personal effects on board the vehicle, for a maximum amount of 601 euro, is covered as well by SUPER PAI, excluding the deterioration thereof and for a maximum amount of 150 € per single object. This coverage may be mandatorily included in some rates.

In the event of theft of the vehicle or luggage, the Lessee must present to ENTERPRISE ATESA the original police report.

Pack total coverage: For the complete customer´s peace of mind, ENTERPRISE ATESA  offers a pack of coverages, including total Theft Coverage, as well as Total Collision Waiver (SCDW), - except for groups 3, 5, 6 and S, for which deductible would be reduced - and Passengers & Driver + Luggage Theft Coverage (SUPER PAI). This coverage can be purchased only in addition to CDW and TP. Non applicable for groups 7 and 8.

Coverage Exclusions: Damages caused to the upper part of the bodywork, to the suspension of vehicles, and to their interiors from the inside, missing pieces and damages derived from such, or deterioration not arising from normal use. Likewise, the damages caused by misuse, negligence or recklessness on the part of the driver, as well as the breach of any of the terms in the general conditions or from the actual legislation

Should the Lessee assume total or partial liability for the vehicle, ENTERPRISE ATESA may require an amount by way of deposit that is equivalent to the liability contracted.

ENTERPRISE ATESA shall have in all rental branches, at customers’ disposal for consultation, a Table of Charges and Exclusions ratified by an expert, with the cost of the repairs and missing pieces not covered by insurance.

OBLIGATIONS OF THE LESSEE: The Lessee shall be obliged to present all the documents required by ENTERPRISE ATESA for vehicle rental. Likewise, he shall be obliged to present the vehicle to a ENTERPRISE ATESA location for any maintenance and / or repair works necessary. Should the Lessee not accomplish this obligation, would be responsible of any damages occurred.

In the same way, ENTERPRISE ATESA reserves the right to refuse rent based on the history of incidents of the Lessee or the breach of the General Conditions.

In the Canary Islands, car rental services shall be attended to by CICAR, whereby the terms and amounts of charges reflected in the present General Conditions shall be maintained, barring specific conditions to the contrary.

General Conditions, Coverage and Deductibles are valid starting from   March 1^st 2014, except in case that special conditions were agreed.

Every price applied by ENTERPRISE ATESA will include IVA (VAT) valid in the moment of service. The IVA (VAT) tax valid on the date of issue is (21%). In case of IVA tax rate amendment the final cost will increase or decrease depending on the tax variation.AUTOTRANSPORTE TURÍSTICO ESPAÑOL, S.A.
